CONFOTUR is the Dominican tourism-incentive regime created by Law 158-01. It is approved for a named project by a specific resolution — never for a neighbourhood, a district or a province. A listing that says "CONFOTUR area" in Bávaro, Cap Cana or Vista Cana tells you nothing. What matters is the resolution number, the project name exactly as approved, and written confirmation that your unit and phase are covered. Approved projects typically carry transfer-tax exemption on the first sale and an IPI property-tax exemption for a defined period; scope and duration come from the resolution itself.

## What to ask for, in this order
1. The CONFOTUR resolution number and date for the project.
2. The project name as it appears in the resolution — marketing names often differ.
3. Written confirmation that your unit, tower and phase fall inside the approval.
4. The exemption period and what it covers in your case.
5. Your independent lawyer's written confirmation, before any deposit.

## Common traps
- "The whole area has CONFOTUR": No zone has CONFOTUR. The approval is always attached to a named project.
- Phase mismatch: Phase 1 approved, your phase 3 not yet approved or never submitted.
- Resale confusion: Resale units where the first-sale transfer-tax exemption no longer applies to you.
- Application presented as approval: A file in progress is not a resolution. Ask for the number and the date.

## How we handle it
When we represent a buyer, we request the resolution and the unit-level confirmation in writing and pass both to your independent lawyer before a deposit is paid. We represent the buyer, not the developer.

## FAQ

### Is CONFOTUR granted to a zone or to a project?
Answer: To a project. Under Law 158-01 the tourism incentive council approves a specific development by resolution. There is no such thing as a CONFOTUR zone, and marketing that calls Bávaro or Cap Cana a 'CONFOTUR area' is not evidence of anything.

### What does CONFOTUR actually exempt?
Answer: Approved projects generally carry exemption from the property transfer tax on the first sale and from annual property tax (IPI) for a defined period. The exact scope and duration come from the resolution, not from a brochure.

### How do I verify CONFOTUR on a unit?
Answer: Ask for the resolution number and date, the project name exactly as approved, and written confirmation from the developer that your specific unit and phase are included. Have your independent lawyer confirm it before you pay a deposit.

### Does CONFOTUR apply to a resale unit?
Answer: The exemption period attaches to the project, so a resale inside a certified project can still sit inside the incentive window for IPI, while the transfer-tax exemption normally applies to the first sale only. Your lawyer should confirm the remaining period in writing.
