A fideicomiso in a sales presentation is a starting point for questions, not approval to transfer money. This Dominican trust structure can hold assets for a defined purpose, but you need to establish what the particular arrangement includes and how it relates to your purchase. Use this checklist with independent Dominican counsel before the next commitment. It does not certify a project or establish your legal rights.

## Identify the exact trust, trustee, project and phase
Request the exact trust name, identification details, trustee and project company. Match the advertised project and construction phase to the purchase document. Ask counsel to verify the trustee’s authority and relevant supervision rather than relying on a bank logo or a similar trading name. The developer, landowner, trustee and contracting seller may be different parties.
Ask for the executed trust instrument, relevant amendments and the documents governing your participation. Access may require authorization or confidentiality arrangements; ask what suitable evidence can be independently confirmed. Record missing documents as unresolved. A trust used elsewhere by the developer does not establish protection for your unit in Bávaro, Cap Cana, Vista Cana or Ciudad Las Canas.

## Verify contributed land and registered encumbrances
Have counsel reconcile the land described in the trust documents with current registry evidence. Distinguish a promised contribution from a completed and appropriately registered transfer. Identify which parcel and phase support the unit you intend to buy, and ask about mortgages, other encumbrances and rights affecting development or transfer.
A trust reference does not prove that land is clear, permits exist or an individual unit title is ready. Ask who must complete each remaining step and what evidence you will receive. Keep the construction timetable, physical delivery and registration of ownership separate; they may involve different documents and obligations.

## Trace buyer payments and release conditions
Reconcile the reservation, signing deposit, construction instalments and final balance separately. For each, establish the account holder, permitted recipient and documented treatment. Obtain independent confirmation through a known channel before using payment instructions. An account name, receipt or mention of escrow does not establish the full custody and control arrangement.
Ask when money may be applied to construction, which conditions must be satisfied and who confirms them. Do not assume that every payment remains untouched until delivery or that every release follows a physical construction milestone. The worksheet identifies evidence to request; it does not approve payments or replace existing contractual obligations.
| Claim to clarify | Evidence to request | What remains unproven | Responsible reviewer |
| --- | --- | --- | --- |
| The project has a trust | Executed instrument and relevant amendments | Whether this phase and purchase are included | Independent counsel |
| The land is protected | Contribution documents and current registry evidence | Encumbrances and remaining transfer steps | Independent counsel |
| Your payment enters the trust | Verified recipient and participation/payment documents | Control and permitted uses of each payment | Counsel and authorized trustee contact |
| Funds follow progress | Release conditions and required confirmations | Which milestones or other conditions actually apply | Counsel and relevant technical adviser |

## Separate trustee duties from completion and repayment guarantees
Identify what the trustee undertakes to administer, verify and report under the operative documents and applicable law. Those duties should not be confused with the developer’s duty to construct, a lender’s financing commitment or an insurer’s cover. Ask who owes each obligation to you and whether you have contractual or beneficiary rights under the arrangement.
If a separate completion, repayment or bank guarantee is advertised, request the issued instrument and have counsel examine its beneficiary, scope, conditions, expiry and enforcement process. A reference to security that has not been issued is an open question. Neither asset separation nor a trustee’s involvement alone establishes that all losses will be reimbursed.

## Clarify delays, funding gaps and termination with independent counsel
Ask how the documents address insufficient sales, funding shortages, delayed work, changes to the project and termination of the trust or purchase. Identify notice recipients, reporting arrangements, repayment obligations and any competing creditor interests. A repayment promise and funds available to satisfy it are different questions.
Have counsel assess applicable law alongside the purchase and trust documents, including consequences of unmet conditions and any relevant deadlines. Do not assume an automatic right to stop paying, cancel or recover funds. If difficulties already exist, preserve the correspondence and obtain advice specific to the transaction before acting.

## Keep an evidence file before the next commitment
Keep a dated record of the documents reviewed, confirmed facts, missing evidence, responsible advisers and next payment or signing date. Resolve inconsistencies in writing. Compare shortlisted properties using the actual unresolved questions rather than awarding a safety score for a trust badge. No checklist eliminates construction or counterparty risk.
Tell Cana Keys your budget, intended use and timing to plan a property tour around suitable candidates. We help compare properties and organize questions for independent advisers. Your own lawyer assesses the arrangement and legal obligations; a tour is not a trust audit, payment approval or guarantee of completion.

## FAQ

### Does a fideicomiso guarantee completion?
Answer: Do not infer a completion guarantee from the label. Have counsel examine the trustee’s duties, the developer’s obligations and any separate security actually issued for the transaction.

### Do all buyer payments enter the trust?
Answer: Do not assume so. Reconcile each payment with the purchase documents, verified recipient and confirmed fiduciary arrangements, including permitted uses and release conditions.

### Is a fideicomiso the same as escrow?
Answer: They are distinct arrangements. Compare the actual asset segregation, custody, control, release and dispute terms with independent counsel instead of treating the names as interchangeable.
