Buying Punta Cana property remotely: power of attorney and closing checks
Editorial update:
If you cannot attend every appointment for a Punta Cana property purchase, ask your independent Dominican lawyer which tasks can be delegated, what authority is needed and which documents the intended recipients will accept. A power of attorney does not verify the property or establish that a payment condition has been met. Keep signing authority, payment controls, physical handover and ownership registration as separate checks. This guide helps you prepare the questions and records; it is not a power-of-attorney template or transaction-specific legal advice.
1. Choose your representative and define delegated tasks
Start with the exact property, parties, purchase stage and appointments you cannot attend. Retain an independent lawyer to advise on the Dominican transaction and proposed representation. A broker can help shortlist properties and gather questions; an inspector assesses condition; a handover representative records what is delivered. One person attending a viewing is not automatically authorised to sign a purchase agreement or accept contractual changes.
Ask who will act, how their identity and professional role will be checked, whether they have any relationship with the seller or developer, and how you will receive reports. Agree the legal engagement and the intended delegation separately. If a lender or another institution is involved, ask whether it has its own identification, document or attendance requirements before relying on a remote plan.
3. Confirm signing, authentication and translation before arranging appointments
Ask your lawyer and the relevant issuing office to confirm the route for the actual document before you sign or book services. Dominican consular notarial services include purchase-related powers. Alternatively, a document issued abroad may require the applicable authentication and Spanish translation steps. Confirm the competent office, document wording, identity evidence, translation and recipient requirements for your file; do not treat a general consular service description as a guaranteed appointment or acceptance.
An apostille is not a universal shortcut. Documents issued in Germany generally require legalisation for use in the Dominican Republic; confirm the route for your document before signing. A German-speaking buyer using a document issued in Canada should not select the route merely because they read this guide in German. Identify where the document is issued and where it will be used, then verify the applicable arrangements. Citizenship, residence and reading language are not interchangeable with document origin.
Also confirm the accepted format. Registry requirements provide for qualifying digital documents, but that does not mean any emailed scan or electronic-signature service satisfies the rules for your transaction. Ask which originals, certified copies, translations or qualifying digital files must be supplied, how they will be validated and who confirms receipt. This guide sets no fixed courier requirement, fee or processing time; obtain current, itemised instructions and quotations.
| Route to discuss | Confirm before using it | Do not assume |
|---|---|---|
| Dominican consular notarial route | Office availability, eligibility, wording, identification and any subsequent formalities | Every consulate has identical appointments or requirements |
| Document issued before a foreign notary | Competent authentication route and required Spanish translation for its intended use | An apostille alone is sufficient in every country pair |
| Digitally signed or electronically submitted document | Eligible signature, validation, filing channel and recipient requirements | A scanned signature is automatically a qualifying digital signature |
4. Keep due diligence and payment controls separate
An authenticated document does not establish that the seller has clean title, the unit matches the contract, permits are in order or a promised project benefit applies. Have the relevant property and contract checks completed and explained by your independent advisers. A representative's ability to sign does not answer whether signing is appropriate. If material evidence is missing, record the uncertainty and ask what must happen before the next commitment.
Maintain a separate payment checklist: contractual amount and currency; condition or milestone; supporting evidence; intended recipient; independently verified account details; approval status; and receipt. Verify changed instructions through a trusted contact route already established independently, not simply a phone number in the change message. Ask your lawyer and bank how authority to sign, bank authorisations and funds release interact in your purchase. Neither a sales calendar nor a power of attorney proves that money is due or that a recipient is correct.
5. Track closing, registration and physical handover separately
Agree what evidence you will receive at each stage and who follows unresolved matters. Ask for the signed transaction documents, itemised payment records and applicable filing reference, then arrange updates on the registration outcome. Distinguish a document signed, a file submitted and ownership registration completed. Your lawyer should explain the legal status shown by each record; a receipt or a set of keys does not answer every ownership question.
Organise physical inspection and handover as a separate assignment. Specify who may attend, what they should inspect or record, which documents they may acknowledge and which issues require your lawyer's advice. A video walkthrough can help you understand a property but cannot replace every physical or professional check. Cap Cana, Bávaro, Cocotal and other communities may have different access and administration procedures; confirm those for the exact building rather than importing a rule from another area.
| Reported event | Evidence to request | Separate question |
|---|---|---|
| Purchase documents signed | Final signed version and any agreed annexes | What payment, filing or contractual steps remain? |
| Registry file submitted | Filing reference and follow-up contact | Has the requested registration been completed? |
| Keys or furnished property delivered | Inventory, inspection limitations, defects and access record | Are legal completion and rental readiness separately confirmed? |
6. Handle changes, expiry and revocation with counsel
If the property, price, representative or intended actions change, ask your lawyer whether the existing authority remains appropriate and what formal amendment or replacement is needed. Discuss duration and revocation before granting the power. Do not assume deleting a file or emailing the representative immediately ends authority against every person or institution. Obtain advice on the applicable formalities, notices, recipients and evidence of delivery, including any outstanding transaction or registry steps.
Keep a secure owner file with the final authority, relevant authentication and translation records, instructions, reports, signed transaction documents, payment receipts and registration follow-up. Planning a visit before deciding? Share your budget and shortlist with Cana Keys to plan an in-person property tour. Appoint your independent lawyer separately. Our viewing service helps you assess properties against your goal; it does not replace legal representation or certify a remote closing.
Remote purchase and power of attorney — FAQs
- Does an apostille prove the purchase is safe?
- No. It authenticates a public document's origin, not the property or the safety of the transaction. The authority's scope, title, contractual conditions and payment instructions still need their separate checks.
- Can I sign a scan or use any electronic-signature service?
- Do not assume that an emailed scan or a service you use at home meets the requirements for this purchase. Ask your independent lawyer which document and signature formats are acceptable to each intended recipient and how any qualifying digital document will be validated and filed.
- Can I revoke the power simply by sending an email?
- Ask your lawyer what formalities and notifications apply to the actual power and transaction. An email alone should not be treated as proof that authority has ended against every recipient. Keep the advised notices, delivery evidence and confirmation of remaining steps.
