Punta Cana property deposits: what to check before you pay

Editorial update:

A request to reserve a Punta Cana property is a decision about documents and money, not just a way to hold a price. Before signing or transferring a reservation payment, ask your independent Dominican lawyer to explain the agreement, the payment’s legal character, the recipient and the conditions for release or repayment. A receipt, a WhatsApp promise and the word “refundable” do not answer those questions on their own. Use this checklist to prepare the file; it does not approve a payment or determine your legal rights.

1. Identify the document and the property

Obtain the complete reservation document and any terms it incorporates before deciding whether to sign. Record the exact unit or parcel, parking or storage if included, price, currency, seller or project company and the person signing for it. Ask counsel to verify authority and explain whether the document creates obligations now, even if it is called a reservation, offer or preliminary form. A short document is not necessarily a minor commitment.

Keep the dated offer, payment instructions and relevant advertised specifications together. For an off-plan unit, distinguish the proposed unit from the underlying land and the phase being marketed. For a resale, identify the registered property and seller. The same discipline applies in Bávaro, Cap Cana, Vista Cana and Ciudad Las Canas; an area name does not establish the property’s legal position.

2. Establish what the payment actually secures

Ask what the payment is called in the signed instrument and how it will be treated: a reservation amount, arras, an advance against the purchase price or another agreed payment. Do not import the meaning of earnest money from your home country. Have counsel explain the applicable law and the actual wording together, including whether the payment’s treatment changes when another document is signed.

Write down the hold period, what starts it, the deadline for the next agreement and whether the price and unit are held exclusively. Clarify who can end the reservation, how an extension is agreed and what happens to the funds if the next contract is not signed. Do not assume a standard deposit percentage, automatic cooling-off period or general right to change your mind. These questions need answers for this transaction.

3. Verify the recipient and the release arrangement

Match the proposed account holder and payment purpose to the agreement. Independently verify instructions through a known contact channel, especially after a message changes an account number or recipient. Ask who has authority to receive the money and obtain an explanation for any mismatch between the seller, developer, intermediary, trustee and account holder. A forwarded screenshot is not independent confirmation.

Find out who controls the funds, when they can be released and what instructions govern a dispute. A lawyer’s account, corporate account, escrow label or fideicomiso reference is not by itself proof of segregation, independence, restricted release or repayment protection. Ask counsel to review the actual arrangement and identify who owes any repayment. Keep the agreed instructions and payment acknowledgement in your private file; do not send identity documents or bank details through an article inquiry form.

4. Connect open checks to written conditions

List the checks still outstanding and who will perform them: seller authority, title and encumbrances, property identification, permits where relevant and any promised project-specific exemption. If your purchase depends on financing, rental permission or another essential condition, explain that to counsel before committing. Discuss how the agreement deals with an unmet condition, insufficient evidence, a deadline or a proposed change.

The worksheet below identifies questions to resolve; it does not create conditions or a right to cancel. Request written agreement on evidence, timing, responsibility and the consequences of an unresolved item. A developer’s delivery history or a broker’s reassurance does not replace the property documents. Do not treat this checklist as permission to miss an existing payment obligation: ask your lawyer how any change must be negotiated.

5. Read repayment conditions and the next contract together

If money is described as refundable, ask for the complete mechanism: qualifying event, notice recipient, notice method, deadline, supporting documents, repayment timing and any deductions or bank charges. Distinguish a cash repayment from a credit toward another unit. Ask whether the person promising a refund is the party obliged and able to make it. A contractual repayment promise is not proof that funds are protected or readily recoverable.

Before signing the next agreement, reconcile the payment already made, its credit against the price and any changed conditions. Ask counsel about the effect of conflicting language versions, incorporated documents, waivers or releases. Neither “the contract decides everything” nor “all reservations are refundable” is a reliable legal conclusion. Applicable law, the instrument and the circumstances must be assessed together. If a dispute has begun, preserve the documents and obtain individual advice; do not rely on this article for a remedy or deadline.

6. Keep a decision file before sending funds

Keep one dated record showing the proposed payment, recipient, document version, unresolved questions, professional responsible and next commitment. Mark a verbal assurance as unconfirmed until the relevant evidence or agreement is obtained. If something is unclear, ask counsel what clarification or amendment is needed before you decide. Do not assume that discovering a problem automatically allows withholding, cancellation, forfeiture or recovery of double the payment.

Reservation deposit checklist — FAQs

Is a Punta Cana reservation deposit automatically refundable?
Do not assume that it is. Ask an independent Dominican lawyer to assess the document, the payment’s legal character and applicable law, including any conditions, notice requirements and deductions. A sales message alone does not establish the outcome.
Does paying a reservation amount mean I own the property?
Do not treat a reservation payment or receipt as proof of registered ownership. Have counsel explain the obligations created by the instrument and the separate steps needed for transfer and registration.
Does an escrow or fideicomiso label guarantee my deposit is safe?
No protection should be inferred from the label alone. Have your lawyer examine the actual custody, control, release and dispute arrangements, who receives your payment and what happens if the transaction does not proceed.
